Terms and Conditions

These Terms and Conditions (“Terms”) govern the use of the CouldWe platform (“Platform”), operated by Crafty Media Ltd (“we,” “us,” “our”), a company based in the UK. By creating an account or using the Platform located at couldwe.com, you (“User” or “you”) agree to be bound by these Terms. If you do not agree, do not access or use the Platform.

1. Company Identification & Scope

  • Applicability: These Terms apply to all users globally. You are responsible for complying with any local laws applicable to you.

2. Eligibility & Age Requirements

You must be at least 16 years old to create an account and use the Platform. By using CouldWe, you confirm that you meet this age requirement.

3. Account Registration & Security

Accurate Information:

You agree to provide a valid email address and any other requested information truthfully.

Account Security:

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Do not share your password with others.

Prohibited Registrations:

You must not create accounts through automated means, impersonate others, or provide false identity information.

4. User Conduct & Content

Prohibited Content:

Places people often look in London. Open a site, find an event you like, then come back here to save the link.

You must not post or share content that is unlawful, harmful, hateful, harassing, defamatory, pornographic, obscene, or otherwise objectionable, nor content that encourages illegal activities.

No Harmful Behavior:

You must not engage in harassment, bullying, or intimidation of other users.

User-Generated Content License:

By posting content on the Platform (e.g. events, messages), you grant us a non-exclusive, worldwide, royalty-free license to display, reproduce, and distribute your content within the Platform as necessary to provide our services.

Your Responsibility:

You remain solely responsible for the content you post and any consequences arising from it.

Automated Content Moderation:

Your content (event details, images, links) may be automatically scanned using AI and image recognition services, including OpenAI for text moderation, AWS Rekognition for image safety (60% confidence threshold), and Google Web Risk API for link verification. Content that violates these Terms may be removed without prior notice. For full details on third-party processors, see our Privacy Policy Sections 12 and 13. To appeal content removal or account actions, contact support@couldwe.com within 30 days.

5. Events & Activities

Disclaimer of Liability:

CouldWe is a social planning and discovery tool. We are not responsible for the quality, safety, legality, or outcome of any real-world events or activities arranged or discovered through the Platform. Engage in real-world activities at your own risk.

Non-Commercial Use:

The Platform is intended for personal, non-commercial use. Companies, event promoters, or commercial entities must not use CouldWe for marketing, advertising, or solicitation. No financial transactions are facilitated on the Platform.

Link Previews:

When you share URLs in events, we automatically extract and cache metadata (title, description, images) from the linked page for display purposes. We are not responsible for the accuracy, copyright status, or content of extracted metadata. If you believe we have improperly extracted copyrighted content, contact support@couldwe.com.

Event Details:

Event details on the Platform may originate from users or external sources. We do not guarantee the accuracy, completeness, or timeliness of event information. Always verify details (time, location, availability) with the original source before attending.

6. Intellectual Property (Platform)

Platform Ownership:

All rights, title, and interest in the Platform, including its design, features, and content we create, are owned by Crafty Media Ltd or our licensors.

No Reverse Engineering:

You must not reverse engineer, decompile, or otherwise misuse our intellectual property or proprietary systems.

7. Disclaimers & Limitation of Liability

“As Is, As Available”:

The Platform is provided “as is” and “as available” without warranties of any kind, express or implied.

No Guarantee:

We do not guarantee that the Platform will be uninterrupted, error-free, or secure. We are not responsible for third-party services or external integrations.

Limitation of Liability:

To the fullest extent permitted by law, we are not liable for any indirect, incidental, consequential, or special damages, or for loss of profits, revenue, or data arising out of or related to your use of the Platform.

8. Termination & Suspension

Our Rights:

We may suspend or terminate your account at any time if we believe you have violated these Terms or applicable laws.

We may also modify, suspend, or discontinue the Platform (in whole or in part) at any time, with or without notice.

Account Deletion:

You may request deletion of your account at any time. Upon request, we will delete your account and associated personal data immediately or within 24-48 hours, except where retention is required for legal, safety, or moderation purposes. Please note: content previously shared with other users may remain visible in their feeds, and we cannot remove data from screenshots, downloads, or search engine caches. Public events may have been archived by third parties before deletion.

Appeals:

If you believe your account was suspended or terminated in error, you may contact us at support@couldwe.com for review.

9. Changes to These Terms

Right to Update:

We may update these Terms at any time. If we make significant changes, we will provide an in-app notification.

Acceptance of Changes:

Continued use of the Platform after changes are posted constitutes acceptance of the updated Terms. You may be required to accept revised Terms to continue using the Platform.

10. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with UK law. You agree that the courts of the UK shall have exclusive jurisdiction over any disputes arising from or related to these Terms or the Platform.

11. Miscellaneous

Severability:

If any provision of these Terms is found invalid or unenforceable, that provision shall be severed, and the remaining provisions shall continue in full force and effect.

Entire Agreement:

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Crafty Media Ltd regarding the use of the Platform.

No Waiver:

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

Force Majeure:

We are not liable for delays or failures caused by circumstances beyond our reasonable control, including natural disasters, internet outages, or government actions.

13. Security & Data Breaches

Security Measures:

We implement industry-standard security measures including encryption, access controls, and regular monitoring to protect your data. However, no system is 100% secure, and we cannot guarantee absolute security of your information.

Data Breach Notification:

In the event of a confirmed data breach affecting your personal information, we will notify affected users via email as required by law. You are responsible for maintaining a current email address and for the security of your account credentials.

Your Security Responsibilities:

You should use a strong, unique password for your account, enable available security features, and notify us immediately if you suspect unauthorized access to your account.

14. Platform Access & Rate Limiting

Fair Usage:

We reserve the right to limit or suspend access if you exceed reasonable usage thresholds or engage in automated access that compromises platform stability. This includes rate limiting on authentication attempts, API requests, and other platform interactions.

Prohibited Activities:

You must not attempt to circumvent rate limits, scrape data from the Platform, use automated bots without permission, or engage in any activity that could harm the Platform's performance or availability for other users.
